THESE TERMS AND CONDITIONS ARE VALID, BINDING AND ENFORCEABLE AGAINST ALL PERSONS THAT ACCESS MPLOY Nigeria's PORTAL, WEB PAGES, APP OR ANY PART THEREOF.
IF YOU DO NOT AGREE TO BE BOUND BY THESE TERMS AND CONDITIONS YOU MUST LEAVE MPLOY Nigeria IMMEDIATELY AS FURTHER USE WILL AUTOMATICALLY BIND YOU TO THESE TERMS AND CONDITIONS.
DEFINITIONS AND INTERPRETATION
- " MPLOY Nigeria" is a copyright product of StreSERT Services Limited of 11 Maye Street, Off Commercial AvenueYaba, Lagos, Nigeria;
- "Portal" is used in this agreement in reference to MPLOY Nigeria
- "User" means any person who enters or uses MPLOY Nigeria, notwithstanding the fact that such a person only visits the home page of the portal;
- References herein to the singular includes the plural and vice versa; and
- Hyperlinks herein to legal documents should be deemed part of these terms and conditions. The fact that some or all of the hyperlinks may, from time to time, be non-operational, shall not affect the validity and interpretation of these terms and conditions.
- 1. GENERAL
MPLOY Nigeria is a career portal which offers services to recruiters, publications, and job seekers. Recruiters and publications enter their jobs on the portal while job seekers enter their CVs.
Job Seekers are responsible for granting Recruiters and Employers access to their CVs. The access level is managed in the Jobseekers Zone section of MPLOY Nigeria, and candidates can choose to have their profiles visible to all recruiters and employers, visible on a permission basis to recruiters and employers or have their profiles completely hidden.
It is the jobseeker's responsibility to inactivate their profile by contacting MPLOY Nigeria should they not be contactable for a period of time. ‘To Inactivate’ means unsubscribing from certain plan benefits that otherwise should have been part, or total sum of service(s) under such a plan.
- 2. ALLOWED USE AND LICENSE
2.1 MPLOY Nigeria licenses the User to view, download, and print the content of the portal, provided that such content is used for private, personal, educational, and/or non-commercial purposes only.
2.2 Content from MPLOY Nigeria may not be used or exploited by Users for any commercial and non-private purposes without the prior written consent of MPLOY Nigeria.
2.3 Users may only access, browse and use MPLOY Nigeria for legitimate personal or commercial purposes and may not use the portal or any of its services and/or products for:
2.3.1 Harmful purposes;
2.3.2 Illegal purposes;
2.3.3 Disclosing, sharing or publishing material that may be offensive, defamatory, regulated, copyrighted, incorrect, untrue, prohibited, infringing or damaging to any person; and/or
2.3.4 The creation, storage and sending of unsolicited commercial communications.
2.4 The caching of the portal shall only be allowed if:
2.4.1 The purpose of the caching is to make the onward transmission of the content from MPLOY Nigeria more efficient;
2.4.2 The cached content is not modified in any manner whatsoever;
2.4.3 The cached content is updated at least every 12 (twelve) hours; and
2.4.4 The cached content is removed or updated when so required by MPLOY Nigeria
2.5 If any User uses content from MPLOY Nigeria in breach of the provisions detailed herein:
2.5.1 MPLOY Nigeria reserves the right to claim damages from the User;
2.5.2 MPLOY Nigeria reserves the right to institute criminal proceedings against the User; and
2.5.3 MPLOY Nigeria shall not be liable, in any manner whatsoever, for any damage, loss or liability that resulted from the use of such content by the User or any third party who obtained any content from the User.
2.6 Hyperlinks to MPLOY Nigeria from any other source shall be directed at the home page of the portal. Links beyond MPLOY Nigeria's home page may only be used with MPLOY Nigeria's prior written consent.
2.7 MPLOY Nigeria shall not be liable, in any manner whatsoever, for any damage, loss or liability that resulted from the use of content, products or services available from the portal, if such content, products or services was accessed through a hyperlink not directed at the home page of MPLOY Nigeria. Persons that wish to link to pages beyond the home page of the portal without MPLOY Nigeria's prior written consent shall do so at their own risk and indemnify MPLOY Nigeria against any loss, liability, or damage that may result from the use of such hyperlinks. MPLOY Nigeria's non-liability for deep linking is because deep links bypass these terms and conditions.
2.8 Users may quote small and reasonable amounts of content available from MPLOY Nigeria and only if such a quote is placed in inverted commas and acknowledged.
2.9 No person may, without the prior written consent of MPLOY Nigeria, frame the portal in any manner whatsoever.
2.10 Apart from bona-fide search engine operators and use of the search facility provided on MPLOY Nigeria by Users, no person may use or attempt to use any technology or applications (including web crawlers, robots or web spiders) to search, collect or copy content from the portal for any purpose whatsoever, without the prior written consent of the MPLOY Nigeria.
2.11 E-mail addresses, names, telephone numbers, and fax numbers published on MPLOY Nigeria may not be incorporated into any database used for electronic marketing or similar purposes. No permission is given or should be implied that information on the portal may be used to communicate unsolicited communications to MPLOY Nigeria and all rights detailed in this T&C are reserved.
2.12 All licenses and/or permissions granted in terms of this clause 2 are provided on a non-exclusive and non-transferable basis and may be terminated or cancelled by MPLOY Nigeria at any time without prior notice or reasons.
- 3. INTELLECTUAL PROPERTY RIGHTS
3.1 All intellectual property on MPLOY Nigeria, including but not limited to content, trademarks (or any confusingly similar trademarks), logos, pictures, video, downloads, domain names, patents, design elements, software, source code, meta tags, databases, text, graphics, icons and hyperlinks are the property of or licensed to MPLOY Nigeria and as such, are protected from infringement by domestic and international legislation and treaties. Subject to the rights licensed to the User in clause 2, all other rights to intellectual property on MPLOY Nigeria are expressly reserved.
3.2 No person may use logos, icons, or trade marks from MPLOY Nigeria as hyperlinks or other purposes without MPLOY Nigeria's prior written consent.
- 4. SOFTWARE AND EQUIPMENT
It is the responsibility of the User to acquire and maintain, at his/her own expense, the necessary computer hardware, software, communication lines and Internet access accounts required to access the Internet and/or download content from MPLOY Nigeria.
- 5. DISCLOSURES
These terms and conditions as well as product and / or service specific terms and conditions govern the sale of goods and / or the provision of services from or through MPLOY Nigeria.
Access to the services, content, software and downloads available from MPLOY Nigeria may be classified as "electronic transactions" and therefore Users have the rights detailed herein and MPLOY Nigeria has, amongst others, the duty to disclose the following information:

5.9 Main business: MPLOY Nigeria is a career portal which offers services to recruiters, employers, corporations, publications, and job seekers. Recruiters, corporations and publications enter their jobs on the portal while job seekers enter their CVs;
5.10 Services: MPLOY Nigeria sells advertising space to companies, individuals, recruiters, employment agencies and employers who wish advertise employment positions online;
5.11 Payment: Credit card, direct deposit and debit card payments;
5.12 Costs: As published on MPLOY Nigeria from time to time;
5.13 Full record of transactions: available to members through username and password login;
5.14 The address of the portal is: www.mploy.com.ng
5.15 Termination of agreement: For recruiters, employment agencies and employers who subscribed for advertising space - through 1 (one) month’s prior written notice and subject to the credit terms of MPLOY Nigeria;
5.16 Security features: secure communications via SSL, authentication via digital certificates and username and password login;
5.17 The official e-mail address of the portal is: firstname.lastname@example.org;
5.18 Alternative dispute resolution: Subject to urgent and/or interim relief, all disputes regarding:
5.18.1 access to MPLOY Nigeria;
5.18.2 the inability to access MPLOY Nigeria;
5.18.3 the services and content available from MPLOY Nigeria; or
5.18.4 these terms and conditions,
shall be referred to arbitration in terms of the expedited rules of Lagos Court of Arbitration (LCA) of Nigeria and such arbitration proceedings shall be conducted in Lagos in English. The arbitration ruling shall be final and the unsuccessful party shall pay the costs of the successful party on a scale as between attorney and own client. 5.19 Users may lodge complaints concerning MPLOY Nigeria at email@example.com
- 6. CHANGES AND AMENDMENTS
MPLOY Nigeria reserves the right, in its sole and absolute discretion, to do any of the following, at any time without prior notice or justification:
6.1 change these terms and conditions;
6.2 change the content and/or services available from MPLOY Nigeria;
6.3 discontinue any aspect of MPLOY Nigeria or service(s) available from the portal; and/or
6.4change the software and hardware required to access and use MPLOY Nigeria.
- 7. PRIVACY
7.1 MPLOY Nigeria shall take all reasonable steps to protect the personal information of Users and for the purpose of this clause, "personal information" shall be defined as detailed in the Personal Information and Data Protection Bill of 2013.
7.2 MPLOY Nigeria may electronically collect, store and use the following personal information of Users:
7.2.1 name and surname;
7.2.2 area code;
7.2.3 street address;
7.2.4 postal address;
7.2.6 contact numbers;
7.2.7 non-personal browsing habits and click patterns;
7.2.8 e-mail address; and / or
7.2.9 IP address.
7.3 MPLOY Nigeria collects, stores and uses the above mentioned information for the following purposes:
7.3.1 Communicate requested information to the User;
7.3.2 Provide services to the User as requested by the User;
7.3.3 Authenticate the User;
7.3.4 Provide the User with access to restricted pages on the portal; and
7.3.5 Compile non-personal statistical information about browsing habits, click-patterns, and access to MPLOY Nigeria.
7.4 Information detailed above is collected either electronically by using cookies or is provided voluntarily by the User. Users may determine cookie use independently through their browser settings.
7.5 MPLOY Nigeria may collect, maintain, save, compile, share, disclose and sell any information collected from users, subject to the following provisions:
7.5.1 MPLOY Nigeria shall not disclose personal information from Users unless the User consents thereto;
7.5.2 MPLOY Nigeria shall disclose personal information without the User’s consent only through due legal process; and
7.5.3 MPLOY Nigeria may compile, use and share any information that does not relate to any specific individual.
7.6 MPLOY Nigeria own and retain all rights to non-personal statistical information collected and compiled by MPLOY Nigeria.
- 8. HYPERLINKS TO THIRD PARTY SITES
8.1 MPLOY Nigeria may provide hyperlinks to websites not controlled by MPLOY Nigeria ("target sites") and such hyperlinks do not imply any endorsement, agreement on or support of the content, products, and/or services of such target sites.
8.2 MPLOY Nigeria does not editorially control the content, products and/or services on target sites and shall not be liable, in any manner whatsoever, for the access to, inability to access or use content available on or through target sites.
- 9. SECURITY
9.1 MPLOY Nigeria shall take all reasonable steps to secure the content of the portal and the information provided by and collected from Users from unauthorised access and/or disclosure. However, MPLOY Nigeria do not make any warranties or representations that content shall be 100% safe or secure.
9.2 Subject to the provisions of laws guiding electronic communications and transactions, if applicable, MPLOY Nigeria is under no legal duty to encrypt any content or communications from and to Users and is also under no legal duty to provide digital authentication of any pages on the portal.
9.3 Users may not deliver or attempt to deliver, whether on purpose or negligently, any damaging code, such as computer viruses, robots or spy ware, to MPLOY Nigeria or the server and computer network that support the portal.
9.4 Notwithstanding criminal prosecution, any person who delivers or attempts to deliver any damaging code to MPLOY Nigeria, whether on purpose or negligently, shall, without any limitation, indemnify and hold MPLOY Nigeria harmless against any and all liabilities, damages, risks and losses that MPLOY Nigeria and its partners / affiliates may suffer as a result of such delivery, attempt or damaging code.
9.5 Users may not develop, distribute, or use any device or programme designed to breach or overcome the security measures of the restricted pages, products and services on MPLOY Nigeria and MPLOY Nigeria reserves the right to claim damages from any and all persons involved, directly and indirectly, in the development, use and distribution of such devices or programmes.
9.6 Users who commit any of offences considered as breach to electronic communications and transactions shall, notwithstanding criminal prosecution, be liable for all resulting liabilities, losses, destruction or damages suffered and/or incurred by MPLOY Nigeria and its partners / affiliates due to or related to these illegal actions.
- 10. DISCLAIMER AND LIMITATION OF LIABILITY
10.1 Subject to the provisions of laws guiding electronic communications and transactions, if applicable, and as far as allowed by law, MPLOY Nigeria (including its owners, employees, suppliers, Internet service providers, partners, affiliates and agents) shall not be liable for any damage, loss or liability of any nature incurred by whomever and resulting from:
10.1.1 access to MPLOY Nigeria;
10.1.2 access to websites linked to MPLOY Nigeria;
10.1.3 inability to access MPLOY Nigeria;
10.1.4 inability to access websites linked to MPLOY Nigeria;
10.1.5 content available on MPLOY Nigeria;
10.1.6 content posted to MPLOY Nigeria by Users;
10.1.7 services available from MPLOY Nigeria;
10.1.8 products available from MPLOY Nigeria;
10.1.9 downloads and use of content from MPLOY Nigeria; and/or
10.1.10 any other reason not directly related to MPLOY Nigeria's gross negligence.
10.2 MPLOY Nigeria is supplied on an "as is" basis and has not been compiled to meet the User's individual requirements. It is the responsibility of the User to satisfy himself or herself, prior to entering into this agreement with the MPLOY Nigeria, that the content available from and through the portal meet the User's individual requirements and is compatible with the User's computer hardware and/or software.
10.3 Information, ideas and opinions expressed on MPLOY Nigeria should not be regarded as professional advice or the official opinion of MPLOY Nigeria and Users are encouraged to consult professional advice before taking any course of action related to the information, ideas or opinions expressed on the portal.
10.4 MPLOY Nigeria does not make any warranties or representation that content and services available from the portal shall in all cases be true, correct or free from any errors. MPLOY Nigeria shall take all reasonable steps to ensure the quality and accuracy of content available from the portal.
10.5 MPLOY Nigeria does not make any warranties or representations that the portal shall be available at all times. Users acknowledge that MPLOY Nigeria may be unavailable due to updates or other causes beyond the reasonable control of MPLOY Nigeria, including, but not limited to virus infection, unauthorised access (hacking), power failure or other "acts of God."
- 11. REMOVAL AND CORRECTION OF CONTENT
Users are encouraged to report untrue, inaccurate, defamatory, illegal, infringing, and/or harmful content(s) available on the portal to MPLOY Nigeria, MPLOY Nigeria will undertake to correct and/or remove such content or any part thereof if the person reporting such content is able to provide reasonable grounds to prove the alleged nature of the content.
- 12. INTERCEPTION OF COMMUNICATIONS
12.1 Subject to the provisions of the regulations guiding interception of communications, the User agrees to MPLOY Nigeria’s right to intercept, block, filter, read, delete, disclose and use all communications (including all "data messages" as defined in these laws) send or posted by the User to the portal, its staff and employees.
12.2 The User agrees and acknowledges that the consent provided by the User in clause 13.1 satisfies the "writing" requirement as detailed in the laws guiding respective regulations.
- 13. ENTIRE AGREEMENT AND SEVERABILITY
13.1 These terms and conditions constitute the entire agreement between MPLOY Nigeria and the User and shall take precedent over any disclaimers and/or legal notices attached to any communications and/or postings received by MPLOY Nigeria from the User.
13.2 Any failure by MPLOY Nigeria to exercise or enforce any right or provision shall in no way constitute a waiver of such right or provision.
13.3 In the event that any term or condition detailed herein is found unenforceable or invalid for any reason, such term(s) or condition(s) shall be severable from the remaining terms and conditions. The remaining terms and conditions shall remain enforceable and applicable.
- 14. AGREEMENTS
The User and MPLOY Nigeria agree that:
14.1 the User shall be bound to these term and conditions and such agreement is concluded in Lagos (Nigeria) at the time the User enters MPLOY Nigeria for the first time;
14.2 data messages (as defined in the data regulation laws) addressed by the User to MPLOY Nigeria shall only be deemed to have been received if and when responded to;
14.3 data messages (as defined in the data regulation laws) addressed to the User by MPLOY Nigeria shall be deemed to be received by the User as detailed in these regulations;
14.4 data messages (as defined in the data regulation laws) addressed by the User to MPLOY Nigeria shall be deemed to have been created and sent by the User from within the geographical boundaries of Nigeria;
14.5 electronic signatures, encryption and/or authentication is not required for valid electronic communications between the User and MPLOY Nigeria; and
14.6 the User agrees and warrants that data messages that are sent to MPLOY Nigeria from a computer, IP address or mobile device normally used by or owned by the User, was sent and/or authorised by the User personally.
- 15. APPLICABLE AND GOVERNING LAW
MPLOY Nigeria is hosted, controlled and operated from the Republic of Nigeria and therefore, the Nigerian law enforced by the Nigerian courts governs the use or inability to use the portal, its content, services, products and these terms and conditions.
- 16. LEGAL COSTS
MPLOY Nigeria shall not be liable for costs incurred by Users to obtain professional advice relating to these terms and conditions
- 17. PAYMENT
17.1 all amounts owing to MPLOY Nigeria must be paid before service will be fulfilled.
17.2 you are obliged to pay for the services that MPLOY Nigeria agrees to provide you with regardless of whether you utilise or fully utilise those services. If you do not provide MPLOY Nigeria with the necessary materials or information for MPLOY Nigeria to deliver these services to you, you are still liable to MPLOY Nigeria for full payment.
17.4 if you do not pay to update your profile when necessary/required, MPLOY Nigeria may disable your account without notice and refuse to supply further services to you.
17.5 you agree that MPLOY Nigeria may disclose this information to a credit reporting agency or any other interested person.
These terms and conditions ("Terms") govern all Advertisers (defined as "Advertiser", "you" and "your") that:
- will place a job advertisement on mploy.com.ng;
- will access MPLOY Nigeria's banners viamploy.com.ng;
- have utilised any features of MPLOY Nigeria or its products offered through the portal.
18.1 you must ensure that all advertisements posted to MPLOY Nigeria comply with all applicable legislation, regulations, by-laws, ordinances and codes of conduct.
18.2 you must adhere to the principles of truth in advertising.
18.3 you are not permitted to insert links to an external website or an externally hosted application form:
- within the details of a job ad except in the apply options;
- within or from a previously approved externally hosted application form;
- within an employer/company profile; or
- within any communications with a candidate on the portal without MPLOY Nigeria's approval which may be granted withheld or withdrawn at MPLOY Nigeria's discretion.
18.4 you are not permitted to promote or refer to brands other than those associated with your business, (or a business operated by a related party to you):
- within the details of a job ad (including from the apply functions);
- from within MPLOY Nigeria's job application process;
- within or from a previously approved externally hosted application form;
- within an employer/company profile; or
- within any communications with a candidate without MPLOY Nigeria's express approval which may be granted withheld or withdrawn at MPLOY Nigeria's discretion.
18.5 you may only post Advertisements on MPLOY Nigeria that are in respect of a genuine employment opportunity that is current as at the time of posting the Advertisement, and for which you are currently recruiting. MPLOY Nigeria reserves the right to request any information from you that it deems necessary to verify that a genuine employment opportunity exists.
18.6 you may not post advertisements to MPLOY Nigeria to any location outside of Nigeria without MPLOY Nigeria's approval. MPLOY Nigeria reserves the right to charge you our then applicable rate for any advertisement posted to any such location in breach of this clause.
18.7 you must ensure that advertisements posted to MPLOY Nigeria are posted to the appropriate category of the portal. It is your responsibility to ensure that you familiarise yourself with the advertising requirements of each available category on MPLOY Nigeria to ensure appropriate placement of advertisements.
18.8 advertisers must ensure that all information entered into any data entry field, as part of the advertisement classification process, relates directly to the relevant data field category. MPLOY Nigeria reserves the right to amend, alter or remove any information that does not meet this requirement.
18.9 MPLOY Nigeria reserves the right and Advertisers must accept as a condition of advertising on the portal, MPLOY Nigeria's right to re-classify advertisements posted to the portal, entitling MPLOY Nigeria to withdraw advertisements from one category of its portal and to re-publish advertisements in another category on the portal.
18.10 standard job advertisements are valid for days stated on MPLOY Nigeria, although you can choose to expire the advertisement earlier.
18.11 you expressly authorise MPLOY Nigeria to store and retain all applications submitted in response to the relevant ad within MPLOY Nigeria Employer segment, rather than emailing those applications to an external source.
18.13 your access to MPLOY Nigeria Employer segment (and the functionality contained therein) will be via a secure login username and password issued to you by MPLOY Nigeria (the Password). The Advertiser is responsible for:
- providing MPLOY Nigeria with the identity and contact details of individuals authorised to access the MPLOY Nigeria Employer segment on your behalf (authorised users);
- setting authority limits for all authorised users;
- ensuring that any Password provided to authorised users is kept secure and confidential.
18.14 you are responsible for the use of the Password issued by MPLOY Nigeria to enable users to gain access to MPLOY Nigeria Employer segment, whether the use is by authorised users or any other person. Any act or omission by an authorised user in respect of the use of the Password and/or the use of MPLOY Nigeria Employer segment that breaches these Terms will be deemed a breach of these Terms by you.
18.15 once access to the MPLOY Nigeria Employer segment has been granted to you by MPLOY Nigeria, the Advertiser will have access to MPLOY Nigeria Employer segment and the functionality therein, unless such access is terminated by us in accordance with these Terms and/or the Product Terms.
All information regarding a job offer is from sources deemed reliable. No representation is made as to the accuracy thereof, and such information is subject to errors, omission, and change of details without notice.
MPLOY Nigeria’s Privacy Statement
This Statement has been prepared by MPLOY Nigeria.
MPLOY Nigeria owns and operates the portal located at www.mploy.com.ng (across desktop, mobile, tablet and apps and including any subdomains) ("the portal"). This statement discloses our information gathering and dissemination practices for the portal.
In this Statement, any reference to “MPLOY Nigeria", "we", "us" and "our" refers still to MPLOY Nigeria.
Users who log on to the portal but do not create an account are referred to generically in this Statement as "users" or "you".
Users who register on the portal to obtain services offered by MPLOY Nigeria are referred to as "Registered Users". Unless the context provides otherwise, references in this statement to "users" or "you" include references to generic users and Registered Users.

What information we collect and how we use it?
We will collect personal data (for example you name and contact details) and also sensitive data (for example, your CV) to provide you with the best possible recruitment experience. We may be required by law to collect additional sensitive information – for example, information relating to ethnic origin, religious beliefs and physical and mental health.
By using our www.mploy.com.ng, you give your permission to us for collecting and processing personal and sensitive information supplied by you. Here are some of the ways in which your information could be used:
- To enable us to give you the best user experience.
- To provide our recruitment services to you.
- To improve our customer service.
- To enable you to submit your CV, apply online for jobs or to subscribe to alerts.
- To send information to prospective employers and clients in connection with the recruitment process in order for them to assess your job eligibility.
- To send you information about details of surveys, promotions, offers, networking or client events and general information about the industry sectors or jobs which we think might be of interest to you – where you have consented to being contacted for such purposes, of course.
- To third parties where we have retained them to provide services that you or our client has requested. Some examples of these are; references, qualifications and criminal reference checking services, verification of the details you have provided from third party source, psychometric evaluation or skill test.
- To regulatory or law enforcement agencies if we believe that we are required by law to disclose it in connection with the detection of crime, the collection of taxes or duties, in order to comply with any applicable law or order of a court of competent jurisdiction, or in connection with legal proceedings.
- To use your information on an anonymous basis to monitor compliance with our equal opportunities policy.
